What is a Probate Bond?

Probate Bonds, also known as Estate Bonds, are bonds that are typically required by the court to protect estate assets. This ensures that creditors and other estate costs are paid prior to assets being distributed to beneficiaries.

Probate Bonds is a general term, depending on the state you may be asked to acquire either a “Personal Representative Bond”, “Curator Bond”, “Administrator Bond”, “Executor Bond”, or “Conservator Bond”.

What is a Guardianship Bond?

Guardianship Bonds are bonds that involve a court appointed Guardian to advocate on behalf of an incapacitated person or Minor, also known as the “ward”. The Guardian is to protect and act in best interest of the ward, ensuring that the ward’s health and assets are protected.

What is a VA Bond?

VA Bonds are bonds that are ordered by the Department of Veterans Affairs. The VA will appoint a Guardian/Fiduciary to act in the best interest of the Veterans health and assets.

This is similar to Guardianship Bonds, but it is not the same. VA Bonds, unlike Guardianship Bonds, are obligated to fulfill the bond with Department of Veterans Affairs; meanwhile, Guardianship Bonds are obligated to be fulfilled with the Governor of the issued state.

VA Bonds are not court appointed, but the Guardian may have an attorney to represent them, during the duration of the bond.

What is a Trustee Bond?

A Trustee Bond is a bond that is ordered by the court when the court determines that a bond is needed to protect the interest of the beneficiaries or is required by the terms of the trust.

How are Bonds issued by Probate Bond Pros?

Once we have received your application, and all requirements are met and approved in-house or by underwriting, we will issue your Bond via Email with instructions.

If you are unable to access your bond by Email, speak with one of our Licensed Professionals on how we can accommodate your needs and ensure you receive your Bond without delay.

What states do we service?

How will I be billed?

Billing is handled through Liberty Mutual. Once we issue the bond, payment will be accessible 48 hours after issuance, through Liberty Mutual at pay.libertymutualsurety.com.

Liberty Mutual will send an invoice by mail, which can take 7-10 days of issuance to receive. If you have not received an invoice after this time period, reach out to one of our Licensed Professionals to obtain the invoice.

Liberty Mutual accepts Credit/Debit Card, E-Check, and Check by mail.

What is the process of issuing bonds?

If you are ready to request your bond, click here to sign up/log in to our portal to obtain your Probate Bond in 2-Hours Guaranteed!

Once you have logged into DARREN™, you can click “Request a Bond” underneath the “Bond Operations” layout. You will then be able to select the Bond type you need, and you will then be prompted to fill in the information necessary for the request. If the field is required, the system will not let you move forward until you have entered the necessary required information.

Once the application is submitted, one of our Licensed Professionals will review the request. If any additional information is needed or there are any questions we may have, we will contact you for further information. Once the bond has been approved in-house or by underwriting, we will send an email with your Bond and instructions on what to do next.

How do I cancel my bond?

Bond cancellations vary based on bond type and bond amount. Most commonly, an order of discharge from the court or documentation that states that the Personal Representative or Fiduciary is released from Liability and/or a surety bond is no longer required, is needed to cancel a bond.

To close or cancel a bond, we must receive appropriate documentation confirming that the Fiduciary’s and/or Personal Representatives responsibilities have concluded.

Can I sign my bond electronically?

In Florida, Pinellas County does accept Electronic Signatures for Probate and Guardianship bonds, while other counties may vary.

What are the bond premium rates?
